1. APPLICATION
1.1 These terms and conditions (‘Terms’) apply to the Seequent Customer Experience Survey Prize Draw (‘Prize Draw’).
1.2 The organiser of the Prize Draw is Bentley Systems International Limited, a limited liability company having a principal place of business at Charlemont Exchange, 5th Floor, Charlemont Street, Dublin 2, Ireland (‘Bentley’).
1.3 By completing and submitting the Seequent Customer Experience Survey (‘Survey’) and nominating your interest in the Prize Draw, you agree that you have read and understood, and agree to be bound by, these Terms.
2. ELIGIBILITY AND METHOD OF ENTRY
2.1 To be eligible for one entry in the Prize Draw, you must:
a. have completed and submitted the Survey between 12.00 am NZT on 11th November 2025 and 11.59 am NZT on 11th December 2025 (‘Prize Draw Period’), the submission of which will be deemed as your entry to the Prize Draw (‘Entry’);
b. have specified your full name and email address in response to the applicable questions in the Survey;
c. have indicated in the Survey that you wish to be entered in the Prize Draw;
d. be aged 18 years or older;
e. not be an employee, contractor, or otherwise engaged by Bentley or any entity of the Bentley group (or an immediate family member of an individual engaged by Bentley or Bentley Group Entities); and
f. not be a government official, being any individual who holds a position of authority or service in a government or public sector organisation (or an immediate family member of a government official).
2.2 You agree and acknowledge that local law and your company’s policies allow you to enter into the Prize Draw and to receive a cash equivalent prize, and that if you are a Winner any tax obligations in relation to the Prize will be your responsibility.
3. DRAW AND PRIZES
3.1 The first 5 entries drawn by Bentley in accordance with clause 3.2 that meet the eligibility criteria described in clause 2 will be the winners of the Prize Draw (in each case a ‘Winner’).
3.2 Bentley will randomly select each Winner through use of a third-party random generator available online (and the parties agree that each Entry will have an equal chance of being drawn).
3.3 There are 5 prizes to be won, each consisting of an electronic gift card (‘Voucher’), issued by Printfection.
3.4 One Voucher will be provided to each Winner, and in each case will be issued in the currency of the Winner’s country (according to Bentley’s customer database record), and will be equivalent to $100 USD (‘Prize’) (based on the applicable currency exchange rate available at www.xe.com at the time Bentley purchases the Prize).
3.5 The Prize:
a. is not transferrable;
b. cannot be redeemed for cash; and
c. cannot be exchanged by Bentley for another item.
3.6 Participation in the Survey is voluntary. Prizes offered as part of the Prize Draw are provided solely as compensation for the time and inconvenience of participation, and do not constitute a benefit of the research itself.
4. NOTIFICATION AND DELIVERY
4.1 Bentley will notify each Winner by sending an email to the email address specified by the Winner in the Survey and will send the Prize to the same email address.
4.2 If Bentley is notified that an email sent in accordance with clause 4.1 is unable to be delivered, Bentley may, in its sole discretion:
a. attempt to contact the relevant Winner again;
b. select a new winner in the manner contemplated by clause 3.2;
c. or retain the Prize and take no further action.
4.3 Bentley will not be liable for:
a. any failure to deliver the Prize (provided that Bentley attempts to deliver the Prize to the Winner’s specified email address in the manner contemplated by clause 4.1); or
b. any failure or inability on the part of the Winner to claim or receive the Prize.
5. DECISIONS
5.1 The decisions of Bentley regarding all aspects of the Prize Draw, including decisions regarding the eligibility of entries, the conduct of the Prize Draw, the interpretation of these Terms, and the allocation of the Prize are final and not subject to challenge.
6. CANCELLATIONS, CHANGES, OR SUBSTITUTION
6.1 To the extent permitted by law, Bentley may, at any time substitute the Prize with a prize of equal or greater value, cancel the award of any or all Prizes, supplement or change any conditions of eligibility, consider or not consider late entries to the Prize Draw or waive any irregularity or informality of any entry to the Prize Draw.
7. VOUCHER PROVIDER TERMS
7.1 Redemption of a Prize is subject to Printfection’s terms and conditions applicable to the issue and redemption of Vouchers, and any other terms and conditions in connection with your use of the applicable retailers’ websites, and Bentley will not be liable for any failure or inability by any Winner to redeem any goods or services through use of the Voucher.
8. BREACH OF TERMS
8.1 Bentley may disqualify your entry into the Prize Draw, or withhold delivery of the Prize from you, if Bentley believes that you have breached any of these Terms.
9. PRIVACY
9.1 Personal information that you provide to Bentley in connection with the Prize Draw and the Prize may be used, held, and disclosed by Bentley for the purpose of conducting the Prize Draw, to facilitate Bentley’s market research, including to develop new products, services, strategies and policies, and otherwise in accordance with our privacy statement, available at https://www.seequent.com/legal-privacy/privacy-policy/.
10. GOVERNING LAW AND JURISDICTION
10.1 The Prize Draw and these Terms will be governed by the laws of Ireland and the courts of Ireland will have the exclusive jurisdiction to hear and determine all claims arising in connection with the Prize Draw or these Terms.
11. SANCTIONS COMPLIANCE
11.1 The Prize is subject to US, EU, and other applicable sanctions laws and regulations (‘Sanctions’). By entering the Prize Draw, you represent and warrant that you are not subject to Sanctions and are not located in or a resident of any country or region subject to comprehensive US sanctions. The list of restricted countries, regions, entities, and individuals is subject to change without notice.
11.2 Bentley will not deliver the Prize to any individual or entity where such delivery would violate Sanctions, and reserves the right to withhold or cancel the Prize if it determines, in its sole discretion, that delivery would violate Sanctions.
